The Department for Work and Pensions states "Evidence shows that work is generally good for health and that often going back to work can actually aid a person’s recovery. On the other hand, staying off work can lead to long-term absence and job loss with the risk of isolation, loss of confidence, mental health issues, de-skilling and social exclusion. The new fit note can help. Doctors will be able to advise people who are on sick leave for over 7 days on whether, with extra support from their employer, they could return to work earlier." The focus will be changed from 'can't to 'can, with the aim of reducing sickness absence which is so detrimental to both employers and employees.
For employers this does mean ensuring that staff with longer absences are carefully assessed to see if some aspects of work can still be undertaken. Employers may be concerned of liabilities in placing staff in activities during a period when a person historically would have been 'on the sick'.
Markel insurance wordings are sufficiently broad to protect organisations from their liabilities here.
