Landscape Contractors
The Insured were landscape contractors instructed to remove a tree from the grounds of a school. Following a survey by the Insured, sub-contractors were instructed to remove the tree. It was subsequently discovered that the tree contained toxic sap from which the sub-contractor's employees suffered burns. A claim was brought for negligence.
Marketing Consultants
As Marketing Consultants the Insured were commissioned to undertake market research with medical practitioners. Once the study was complete it became obvious that the results were flawed and after investigation it was discovered that a Team Leader had been falsifying the data and encouraging other employees to ‘make stuff up’. A claim was brought for the cost incurred of repeating the market research, loss of profit as a result of reduced projects and delays and of course for attendant legal costs and expenses.
Graphic Design Consultants
The Insured prepared the design of a new brochure for the claimant to coincide with a planned sales launch. The brochure had been approved but the Insured inadvertently sent an incorrect draft version to the printer and this wasn’t noticed until the brochure had been printed and delivered. The claimant subsequently requested a reprint of the brochure at the Insured's costs and additional costs of the delayed product launch.
Employment Consultants
Claims made against the Insured in respect of poor performance or unreliability of staff supplied by them to clients alleging failure to properly assess the skills and the background of people supplied for specific projects. Further allegations made that the terms of the engagement i.e. probation and notice periods incorrectly quoted leading to potential employment disputes. Indemnity sought for additional costs incurred by clients to remove and replace the individuals involved.
