Why do computer programmers need insurance?

Companies worldwide rely on software to operate their business across key functions such as finance, billing, databases and e-commerce. If a program you are responsible for programming or maintaining fails due to an oversight on your part, and your client’s incurs a loss as a result, they may take legal action against you to recover their costs.

What it covers

Computer programmer insurance from Markel includes a range of different optional covers that have all been designed to protect against the risks most commonly experienced by computer programmers, which include:

Cyber-attack causing data breach

Programming you undertook for a module of a client’s IT system is deemed unfit for purpose. Your client pursues you for the cost of engaging another IT contractor to put right your mistakes. Covered by professional indemnity insurance.

Software failure

An error made when patching your client’s payroll program causes the system to go down, resulting in a number of staff not being paid on time. You are held responsible for the error and your client takes legal action against you seeking compensation.  Covered by professional indemnity insurance.

Client injury

A client trips over your laptop wire and injures themselves. They are unable to work for a number of weeks and make a personal injury claim against you.

  • Professional indemnity insurance

Professional indemnity insurance is often a contractual requirement for computer programmers to begin work for their client.

It covers the legal costs of defending your business against allegations of professional negligence as well as any damages awarded against you if your defence is unsuccessful.

    Potential claims may include:

    -       Coding errors leading to software begin deemed unfit for purpose

    -       Copyright infringement

    -       Breaches of contract

Additionally, professional indemnity insurance includes mitigation of loss cover, which pays the costs incurred in putting your mistake right before your client has to make a claim against you.

    Limits from £50,000 to £5m.

  • Public liability insurance

Public and product liability insurance protects computer programmers against allegations of injury or damage caused to third parties – for example, personal injury claims. It covers the legal costs of defending the claim, as well as any compensation payments that may be payable.

Limits range from £1 million to £5 million.

  • Employer's liability insurance

Employer’s liability insurance is legally required if your business has employees. Markel employers’ liability insurance covers you against illness or injury claims filed by your employees as a direct result of their company duties.

If you employ any staff within your business – regardless of their role - this cover is mandatory. Limits range up to £10 million.

  • Legal expenses insurance

Legal expenses insurance covers the costs of defending you as a director or officer of your company against allegations of wrongful acts and any damages subsequently awarded against you. Cover is also provided for the legal costs and expenses of defending actions for disqualification as a director, investigations and extradition proceedings. Limits range from £100,000 to £5m.

  • Directors and officers insurance

Directors and officers insurance handles your defence costs if you are a director or officer of a company and are accused of negligent working practices. Any damages awarded against you as a consequence are also covered.

It also handles expenses associated with extradition proceedings, general investigations and motions toward disqualification as a director.

Limits range from £100,000 to £5 million.

  • Office insurance

Office insurance covers your business equipment (and office, if you own one) against accidental damage and theft, including:

    -       IT equipment

    -       Office premises

    -       Office contents

There is an option to protect business equipment such as laptops and mobile phones on a worldwide basis. You may wish to consider this cover if you conduct work abroad or travel regularly for business.

Business interruption cover also protects your company against any extra trading expenses and loss of income resulting from the property damage or theft.

  • Cyber and data risks insurance

Cyber and data risks insurance covers your business against the rising threat of cyber crime, paying the costs incurred after a cyber attack on your business.

    Costs covered include:

    -       Meeting ransom demands

    -       Notifying clients

    -       Potential business net profit losses

    -       Restoring data and equipment

Markel’s cover helps pay your legal defence expenses and any subsequent damages you are required to pay out to affected parties.

Frequently asked questions

  • I need to arrange computer programmer insurance to secure a client contract – do you provide proof of cover?

Yes. When you purchase any policy with Markel, you will receive your policy documents instantly via email. These documents include a ‘Confirmation of Liability Insurance’, which can be presented as proof of cover to your client and includes all policy details.

  • Is my past work covered?

If you have held uninterrupted professional indemnity insurance prior to taking out a policy with us then yes, past work is covered.

However, we are unable to cover past work if you did not hold professional indemnity insurance continuously prior to arranging a policy with us.

    Examples include:

    -       Never holding professional indemnity insurance before

    -       Previously holding professional indemnity insurance, but not renewing it

    -       Cancelling a professional indemnity policy during your contract

Call us on 0800 640 6600 if you need any further clarification on whether your past work is covered with our insurance.

  • What's the difference between professional indemnity and public liability?

Professional indemnity insurance protects you and your business against cases of professional negligence where you are liable. An example could be if you or an employee make an error while coding a piece of software, leading to a bug in the program that proves costly to a business.

Public liability insurance covers against cases of third-party personal injury or illness claims, occurring during the course of your business. These claims are covered, alongside damage to third-party property – such as client-owned smartphones or laptops.

You should consider arranging both covers as they protect against different scenarios.

  • What limit of cover should I choose?

Before beginning contracted client work, you may wish to check with your industry association or client whether you are required to have a minimum limit of cover.

If you have never arranged insurance cover before, a useful guide is to consider what the likely costs would be in a worst case scenario, and arranging a limit of cover that would cater to this.

We offer a variety of limits and levels of cover, giving you the option to create a insurance package based on your individual requirements.
